Our TMB Lawyer Serves Those Facing Allegations Nationwide
The practice of medicine is regulated by the Texas Medical Board, or TMB, which uses the power granted to it by the Texas Medical Practice Act to issue and discipline licensed medical professionals. With the authority provided to it, the TMB can issue medical licenses to MDs and Doctors of Osteopathy (DOs).
As a licensed physician for more than 30 years, I am intimately familiar with the Texas Medical Board, and I know how to aggressively represent doctors who have been brought before the TMB without offending or attacking the medical board itself. Backed by years of experience working in both the medical and legal fields – more than 50 years in total – I am prepared to defend my clients in any of the following situations:
Restriction of medical license
Denial of medical license
Medical board complaint investigations
Medical board appeals
Medical board informal settlement conferences (ISCs)
Experienced Representation for Procedural and Substantive Disciplinary Cases
A disciplinary case with the Texas Medical Board that involves a medical professional’s license will be categorized by two areas, which are referred to as procedural and substantive. The procedural stages of a disciplinary case with the TMB can progress as follows:
- TMB receives initial complaint about the doctor
- TMB conducts a formal investigation of the doctor
- Investigation is referred to the legal division and informal settlement conference (ISC) is scheduled
- ISC negotiates an Agreed Order
- Medical Board staff lawyer files a formal complaint to the State Office of Administrative Hearings (SOAH) and conference follows
- Mediation of contested case hearing at SOAH is conducted as an attempt to expedite a resolution for the dispute
- Doctor is given the opportunity to make an appeal or motion for a rehearing
- Doctor attends a temporary suspension hearing
Depending on the circumstances involved in your case, your sequence of events with the TMB may not proceed exactly as listed above. As a practiced Texas medical board lawyer, I may be able to cut the process short for you. I am also here to help medical professionals who have been accused of violating the terms of their probation or Agreed Order.
